থানা-পুলিশ-আদালত রাখার দরকার কি?

আজ আরেকবার আতংকিত হলাম একজন সাংসদের ক্ষমতার অপব্যবহার দেখে। সারাদেশ যখন নারায়ণগঞ্জের এক শিক্ষকের ধর্ম অবমাননা নিয়ে মন্ত্যব্যের ঝড় তুলছেন সামাজিক যোগাযোগ মাধ্যমে তখন আমার মাথায় ঘুড়ছে – “আমাদের দেশে বিভিন্ন অপরাধের শাস্তির জন্য থানা-পুলিশ-আদালত রাখার কি দরকার, বুঝলাম না? সেলিম ওসমানদের মতো এক একজন বাঘা টাইপ-এর এমপি-ই যথেষ্ট। কি দরকার শুধু শুধু দেশবাসীর টাকা নষ্ট করে থানা-পুলিশ করার?”

ওইদিন আসলেই কি হয়েছিলো তা আমার জানা নেই, ঘটনা অনেকটা ঘোলা আমার কাছে। একেক লোক একেক কথা বলছেন। তাই ওই ঘটনা নিয়ে আমি এই মুহুরতেই কিছু বলবো না।

তবে আমার যতদূর মনে পড়ে বাংলাদেশের দন্ডবিধি অনুযায়ী ধর্ম অবমাননাকারীদের বিরুদ্ধে রয়েছে একটি কঠোর আইন, যার কারনে বেশ কিছুদিন ধরেই দেখা যাচ্ছে ধর্মে অবিশ্বাসী বিভিন্ন ব্লগারদের গ্রেফতার, মামলা ইত্যাদি। আসুন দেখি আমাদের দণ্ডবিধি কি বলছে ধর্মীয় অবমাননা নিয়ে, আপনাদের বোঝার সুবিধার জন্য দণ্ডবিধিটি নিচে তুলে ধরলামঃ

১৮৬০ সালের পেনাল কোডঃ

295. Whoever destroys, damages or defiles any place of worship, or any object held sacred by any class of persons with the intention of thereby insulting the religion of any class of persons or with the knowledge that any class of persons is likely to consider such destruction, damage or defilement as an insult to their religion, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

295A. Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of the citizens of Bangladesh, by words, either spoken or written, or by visible representations insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. (এটা মূল ১৮৬০ আইনে ছিলোনা, কিন্তু ১৯২৭ সালে যোগ করা হয়)

296. Whoever voluntarily causes disturbance to any assembly lawfully engaged in the performance of religious worship, or religious ceremonies, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

297. Whoever, with the intention of wounding the feelings of any person, or of insulting the religion of any person, or with the knowledge that the feelings of any person are likely to be wounded, or that the religion of any person is likely to be insulted thereby, commits any trespass in any place of worship or on any place of sculpture, or any place set apart for the performance of funeral rites or as a depository for the remains of the dead, or offers any indignity to any human corpse, or causes disturbance to any persons assembled for the performance of funeral ceremonies, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

298. Whoever, with the deliberate intention of wounding the religious feelings of any person, utters any word or makes any sound in the hearing of that person or makes any gesture in the sight of that person or places any object in the sight of that person, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

একটু খেয়াল করে দেখুন ২৯৫এ -তে কি লিখা আছে। “কেউ যদি ইচ্ছাকৃতভাবে, তার বক্তব্যে বা লিখায় অথবা কোন অঙ্গভঙ্গিমা দিয়ে বাংলাদেশি কোন নাগরিকের ধর্মীয় অনুভুতিতে আঘাত হানে, তা একটি দণ্ডনীয় অপরাধ। যার শাস্তি সর্বচ্চো দুই বছরের কারাদন্ড বা জরিমানা অথবা দুটিই করা হবে”

এটি তো আমার কথা না, আমাদের দেশের আইন বলছে এই কথা। দেশে এই আইন যেহেতু আছে সেহেতু আইন অনুযায়ীই এর বিচার হওয়া উচিত। একজন সংসদ সদস্য কিভাবে নিজের হাতে আইন তুলে নিয়ে শাস্তি দেন, তা আমার বোধগম্য নয়।

এবং এই ঘটনা থেকে এটিই প্রমাণিত হয় যে, বাংলাদেশের রাজনীতিবিদদের হাতেই আছে অসীম ক্ষমতা। তাঁরা বিচার করতে পারেন, সালিশ করতে পারেন। আদালতের কি দরকার? কি দরকার শুধু শুধু জনগণের ট্যাক্স-এর টাকা খরচ করে আইন-প্রশাসন ও আদালত চালানোর?
